Township clerk Meredith Tomczyk appointed acting township manager
Although council originally approved resolutions to “remove” Mitchell from the position after Mitchell’s nearly four years with the township, eventually the two sides reached a settlement in which Mitchell left her position voluntarily.
Of note, when council originally set to “remove” Mitchell as township manager, the resolution to do so did not list her removal as “for cause,” which state law outlines as “conviction of a crime or offense involving moral turpitude.”
As Mitchell was not set to be removed “for cause,” state law entitled her to any unpaid balance of her salary, in addition to salary for three calendar months following her departure.
Those same terms were eventually included in the settlement through which Mitchell voluntarily resigned from her position.
While council did not publicly comment on Mitchell’s resignation at the time of her departure, nor throughout the rest of the year, township solicitor Tyler Prime described the settlement reached between the parties as an “amicable agreement” that allowed both parties a “clean break.”
“Township council aspires to employ the absolute best people to run the many departments of the township, and this is in the furtherance of that goal,” Prime said at the time.
Following Mitchell’s departure, township clerk Meredith Tomczyk was appointed as acting, interim township manager, which continued throughout the end of the year.
